These terms and conditions govern your use of the BAMKO Store. The term "Bamko store" will be synonymous with "My Gym store" By placing an order through the BAMKO Store, you express your understanding and agreement that you are bound by these Terms. If you are unwilling to be bound by these Terms, you may not use the BAMKO Store.
These Terms apply only to orders you place using the BAMKO Store. If you elect to purchase from other online retailers, using links provided on www.onlinemygym.com product pages, orders placed with those vendors may be subject to different terms. |

Order Validation and Acceptance

When you place an order through the BAMKO Store, we may verify your method of payment, shipping address and/or tax exempt identification number, if any, before processing your order. Your placement of an order via the BAMKO Store is an offer to purchase our products or services. Bamko may accept your order by processing your payment and shipping the product or documentation of service, or may, for any reason, decline to accept your order or any part of your order. No order shall be considered to be accepted by Bamko until the product has been shipped. If we decline to accept your order, we will attempt to notify you using the e-mail address you have provided with your order. |

Quantity Limitations

Bamko may limit or cancel quantities available for purchase on any order on any basis, and to alter the availability or duration of any special offers at any time. Bamko may reject any order, or any part of an order. Bamko may limit or prohibit sales to resellers or dealers via the BAMKO Store. |

When you place an order through the BAMKO Store, you are required to provide a valid e-mail address, which we may use to communicate with you regarding the status of your order, advise you regarding shipment of backordered products, and to provide you with any other notices, disclosures or other communications relating to your order. You agree that Bamko will not be responsible for any damage you incur, or information you do not receive, as a result of your failure to provide a valid e-mail address. |

Product Display/Colors

Bamko attempts to display as accurately as possible the colors of the products shown on the Site. However because the colors you see will depend on many factors, including your monitor or printer, Bamko cannot guarantee that the color you see matches the product color. |

Bamko makes every effort to provide current and accurate information relating to Bamko's products, services, and prices, but does not guarantee the currency or accuracy of any such information. Information relating to Bamko's products and services is subject to change without notice. Prices are subject to change at any time prior to Bamko's acceptance of your order. In the event we discover a material error in the description or availability of a product or service that affects your outstanding order with Bamko, or an error in pricing, we will notify you of the corrected version, and you may choose to accept the corrected version, or cancel the order. If you choose to cancel the order, and your credit card has already been charged for a purchase, Bamko will issue a credit to your credit card in the amount of the charge.
Prices that appear on the site are BAMKO Store prices unless otherwise indicated. BAMKO Store prices are not intended to represent the price of Bamko products at other retail stores. Prices at other retail stores are set by the retailer. |

Security and Privacy

The BAMKO Store follows the industry standard, Secure Sockets Layer protocol, "SSL," for the transfer of data over the internet.
When placing an order online, a "key-lock" icon will appear in the bottom right of your browser window. This icon is your confirmation that SSL has been activated for the transfer of your personal information. A second indication of SSL activation is that the displayed URL will begin with "https". |

Payment and Shipment

You may pay for your order with one of the following major credit cards, issued in the United States of America: Visa®, MasterCard®, American Express®, and Discover® cards. Orders placed before 2 p.m. PST, Monday through Friday, will generally be processed, billed, and shipped within 24 hours. Orders placed after 2 p.m. PST, Monday through Friday, or on weekends, will generally be processed and billed that day, and will generally be shipped the following business day.
In most cases, your credit card will not be charged if Bamko declines to accept your order. If your card has been charged, Bamko will process a refund.
In the event your shipment will be delayed more than thirty (30) days after the date of your order, Bamko will attempt to notify you by e-mail, using the e-mail address you provided, and you may elect to cancel the order. If you elect to cancel the order, Bamko will issue a refund.

Shipping and Handling
|
Shipping and handling charges will be added to the cost of your order. Generally, all orders are shipped within 24 hours of receipt, Monday through Friday. Unfortunately, we are unable to ship to PO, APO, or FPO boxes.
Orders received by 2 p.m. PST will generally be shipped the same day. In order to receive a product on the next business day, you need to place your order before 2 p.m. PST. Orders are not shipped or delivered on Saturdays, Sundays or national holidays.
Note: All orders to Alaska and Hawaii must be shipped Next business day and will arrive in 2 business days. Next business day orders to some remote continental U.S. locations won't arrive the next day.
Packages sent "Standard (3-8 Business Days)" should arrive within 3-8 business days, depending on destination.
Note: "Business day" means Monday through Friday except for national holidays

Sales Tax

Bamko collects and remits sales taxes as required by law on purchases made via the Site. If you have tax-exempt status, you must provide a valid tax exemption number evidencing your status prior to time of purchase. Bamko will not refund tax amounts collected in the event a valid number is not provided. If you provide a number that is not accepted for any reason by any governmental or regulatory authority, and Bamko is required to pay tax on your purchase, you will reimburse Bamko for the amount of such tax, and Bamko's reasonable expenses incurred in connection with the payment and collection of such tax. Buyers outside the state of California are exempt from California state tax. |

Warranties

The only warranties Bamko provides with respect to any product or service purchased through the BAMKO Store are those warranties, if any, set forth in the written Bamko documentation accompanying such product or service. |

Return Policy

Bamko will only accept returns on merchandise that is defective or otherwise damaged within 30 days of purchase date unless otherwise specified by BAMKO. Please contact 1-888-99-BAMKO to organize a return. |
